Family law
Family is probably the most important thing in life. Make sure to seek advice from your notary on decisions that could have a significant impact on your family life.
Solemnization of marriage
You and your future spouse decide to tie the knot by marrying or entering into a civil union. You can ask your notary to perform the ceremony. More importantly, your notary can properly inform you of the rights and duties you will have as a spouse once the union has been declared official.
Wedding contract
A marriage contract allows you to choose your matrimonial regime (marital property system) and decide on other important aspects of your married life. The contract can be drawn up before or after you get married and is used as a reference in the event of a divorce or separation. Therefore, it is critical that you consult your notary before getting married to ensure that the marriage is for better, and not for worse.
Cohabitation agreements between common-law partners
Whether you’ve just started living together or have been together for years, you don’t have the same rights as a couple that is married or in a civil union. Common-law spouses are not protected if they separate. Your notary can help you prepare a cohabitation agreement that will protect you throughout your relationship, even if you separate.
Amicable break-up
Your notary can help you achieve a separation in a respectful and cooperative manner. If you have a cohabitation agreement, a notary will guide you in fulfilling your rights and obligations. If you don’t have one, you will get the advice needed to find long-term solutions that will meet your own and your family’s needs.
Joint application for divorce on draft agreement
As of February 21, 2017, your notary can assist you with a joint application for divorce. If you and your spouse agree on the conditions of your separation, a notary can present the application for divorce in court in order to obtain a divorce judgment.
